Election scrutiny is a matter for the Bundestag (Article 41 of the Basic Law). Parliament decides on the validity of elections to the German Bundestag and on rights violations in the preparation or conduct of an election (Section 1 of the Scrutiny of Elections Act). The same applies to the elections of German Members of the European Parliament (Section 26 of the European Elections Act). The plenary’s decision is prepared by the Committee for the Scrutiny of Elections. Any person entitled to vote can submit an objection to an election within two months after the day on which it was held, which triggers a review of the preparation and conduct of the election to ascertain its legality. Appeals against Parliament’s decision can be made to the Federal Constitutional Court.
